Borough Council of West Chester, adjourned Meeting minutes (January 26, 1960).

Council members present: Mosteller, Spaziani, Conner, Cosgriff, Thomas, Baldwin and Underwood.

Also present: Mr. Marrone (Solicitor), Mr. Shay (Controller), and Mr. Bayliss (Public Works).

Called to order at 5 P.M. [...]

Motion by Mr. Thomas, seconded by Mr. Underwood to approve the request of the West Chester State College for permission to hook-up the new Special Education Building to present Borough water and sewer lines was granted. Secretary was instructed to write a letter to the proper authorities advising them of this action and also that no further similar requests could be considered until the Borough utility expansion program is completed.

Council members present: Spaziani, Conner, Cosgriff, Thomas, Baldwin and Underwood.

Also present: Mr. Marrone (Solicitor), Mr. Shay (Controller), Mr. Bayliss (Public Works) and Mr. Mussleman (Housing Inspector).

Called to order at 7 P.M. [...]

Request from Daniel Fortuna that parking on W. Chestnut St. between Darlington and New Sts. be restricted to two hours between 9 A.M. & 5 P.M. Motion by Mr. Cosgriff, seconded by Mr. Baldwin to approve the request for three hour parking and referred to Police Committee.


1960/04/06
Borough Council of West Chester, special meeting minutes (April 6, 1960).

Council members present: Spaziani, Conner, Cosgriff and Baldwin.

Also present: Mr. Marrone (Solicitor), and Burgess Lucas.

Called to order at 8 P.M.

President Mosteller requested Solicitor Marrone to outline the purpose of the meeting. Mr. Marrone explained in detail that, as advertised, the meeting was a public hearing called as a result of a petition submitted by David and Ethel Ginsburg and the United Realty and Construction Co. requesting a change in zoning from "B Residence District" to "Business District" of the tract of land bounded on the north by Linden St., on the east by a public alley, on the south by Rosedale Avenue and on the west by High Street. He also read the entire petition and then called on Mr. Dallett Hemphill, attorney for the petitioners.

Mr. Hemphill called on Mr. F. S. Wood, president of the United Realty and Construction Co. who testified relative to proposed plans to convert the Ginsburg property into a public dining room with a seating capacity for 125 people and parking facilities for about 100 cars.

Mr. Hemphill also called on Mr. Norman Hume, architect for Mr. Wood, who reviewed the proposed plans and presented an architect's sketch.

Mr. Hemphill also called on about nine other witnesses who testified in favor of the petition and also submitted a number of letters favoring the granting of the petition.

Mr. Marrone called upon any interest citizens who were not in favor of the petition. Dr. Walton Pederson, of 703 S, High St., spoke at length against granting the petition and presented a letter signed by five residents of the area protesting the change.

Motion by Mr. Cosgriff, seconded by Mr. Conner, to defer action on the petition until the regular monthly meeting on April 13, 1960.

Council members present: Spaziani, Conner, Cosgriff and Underwood.

Also present: Burgess Lucas, Mr. Marrone (Solicitor), Mr. Shay (Controller), Mr. Bayliss (Public Works) and Mr. Musselmam (Housing Officer).

Called to order at 7:30 P.M. [...]

Motion by Mr. Conner, seconded by Mr. Baldwin, to approve Ordinance No. 9-60, "Amending the Zoning Ordinance" to change all that area bounded by High St. on the west, Linden st, on the north, Rosedale Ave, on the south, and a Public Alley on the east from a "B residence District" to a "Business District." Mr. Cosgriff voted no. [...]

Housing Officer reported that there were several houses that were not habitable and should be condemned. The properties are located at 634 S. Matlack, 403 E. Barnard St., rear of 522 E. Miner St., 1 N. Franklin St., and 18-20 S, Church St. The latter was referred to Mr. Weiler to inspect and recommend proper action. It was suggested that a meeting of members of Council with the Housing Officer, Health Officer and Burgess be held for the purpose of determining what courses of action were available relative to correcting situations such as reported by the Housing Officer. Mr. Baldwin discussed the desirability of creating a Borough Planning Commission. After discussion and motion by Mr. Conner, seconded by Mr. Baldwin, Council decided to explore this matter and request recommendations for membership on the Planning Commission from the Chamber of Commerce, United Fund, Banks and Realtors.

Mr. Baldwin reported on progress relative to membership on the proposed Borough Planning Commission. Solicitor was requested to prepare an ordinance establishing a Department of Borough Planning and creating a Planning Commission. [...]

Borough Council of West Chester, special meeting minutes (May 5, 1960).

Council members present: Spaziani, Conner, Cosgriff, Baldwin. (Mr. Baldwin left meeting at 9 P.M.)

Also present: Burgess Lucas, Mr. Marrone (Solicitor), Mr. Mussleman (Housing Inspector), Health Officer Dr. Pyle and Fire Chief Still.

Called to order at 8 P.M.

President Mosteller opened the discussion by outlining problems relative to corrective action concerning unsuitable housing, health and sanitation conditions in various sections of the Borough.

After considerable discussion it was brought out that a number of the conditions could be abated by cooperative action of Borough personnel responsible to inspect such conditions. It was brought out that the Borough needed a local Fire Code.

Motion by Mr. Cosgriff, seconded by Mr. Conner, to authorize the president of Council to appoint a committee to develop a local fire code. President Mosteller appointed to serve on this committee the following: Fire Committee of Council, the Fire Chief and one member from each Fire Co.

Solicitor Marrone presented Ordinance No.11-60, providing for the establishment of a Department of Borough Planning and creating a Borough Planning Commission. After a motion by Mr. Baldwin, seconded by Mr. Conner, the ordinance was approved.

1960/06/15
Borough Council of West Chester, adjourned meeting minutes (June 15, 1960).

Council members present: Spaziani, Conner, Cosgriff, Thomas, Baldwin and Underwood.

Also present: Mr. Marrone (Solicitor), Mr. Bayliss (Public Works) and Salvatorelli and Oster of Albright & Friel, Inc.

Called to order at 8 P.M.

Dr. I. M. Waggoner presented and read a petition signed by residents in the Marshall Square Park area requesting Council to rescind their prior action of installing a macadam basketball court in the Park. [...]

Solicitor Marrone presented and read Ordinance No. 12-60, "An Ordinance providing for the licensing and regulation of Taxicabs and Taxicab Operators and Owners." On motion of Mr. Cosgriff, seconded by Mr. Baldwin, the Ordinance was approved and adopted as read, by seven affirmative votes. Referred to Solicitor for advertising. [...]

Mr. Thomas left meeting at 10 P.M.

Discussion was resumed on petition submitted at beginning of meeting relative to Marshall Square Park. After considerable discussion the motion of Mr. Baldwin, seconded by Mr. Conner, to reaffirm the action of the Recreation Commission was a].proved. President Mosteller and Mr. Cosgriff did not vote.

Council members present: Mosteller, Spaziani, Thomas and Baldwin.

Also present: Burgess Lucas, Mr. Marrone (Solicitor), Mr. Shay (Controller), Mr. Bayliss (Public Works) and Mr. Mussleman (Housing Inspector).

Motion by Mr. Baldwin, seconded by Mr. Thomas, to accept the resignation of Patrolman John Harris, effective August 7, 1960, with regret.

After a motion by Mr. Baldwin, seconded by Mr. Thomas, the secretary was directed to request the Civil Service Commission to hold an examination for the purpose of filling two vacancies in the position of Patrolman in the Borough Police Dept. [...]

Letter addressed to Dr. Frain, acting president, West Chester State College, was read advising of the withdrawal of Borough objections to construction projects at the College under Act 730, contingent upon legislative authorization for reimbursement by the State to the Borough for providing necessary water and sewer facilities. Mr. Cosgriff reported on meeting of September 8, 1960 of Civil Service Commission. After a motion by Mr. Cosgriff, seconded by Mr. Underwood, the recommendations of the Commission were accepted and the appointment, pending physical examination, Police Department clearance and personal interview, of Elmer R. Schmidt and Richard C. Steward as Patrolman in the Police Department were approved.

Letter received from West Chester Fire Department suggesting the adoption of a Fire Code. Referred to Fire Committee.

Control of traffic and parking at College football games was discussed and referred to Police Committee. [...]

Letter received from Pa. Department of Property and Supplies, Bureau of Engineering and Construction, reporting on conference held on August 20, 1960 relative to Expansion of Water and Sanitary Sewage System in connection with building program of West Chester State College. [...]

Borough Council of West Chester, special meeting minutes (October 5, 1960).

Council members present: Mosteller, Spaziani, Conner, Cosgriff, Thomas, Baldwin and Underwood.

Also present: Mr. Allen Olin (for Solicitor Marrone) and Mr. Carlton Turner (Planning Commission).

Called to order at 8 P.M.

President Mosteller requested the Secretary to read recommendations dated October 10, 1960 received from the Planning Commission.

President Mosteller asked the Secretary to read the Notice of the meeting as advertised and then called on any person in attendance who wished to speak relative to the proposed amendment to change the area East of Church Street and North of Barnard Street from "B" Residence to "Business".

Mrs. Smith, the petitioner for the change, spoke in favor of the proposed amendment. No one present spoke against the proposed amendment. After a motion by Mr. Baldwin seconded by Mr. Conner, the proposed amendment was approved by a vote of 7 Yeas. [...]

Also present: Mr. Marrone (Solicitor), Mr. Bayliss (Public Works), Mr. Mussleman (Housing Inspector) and Mr. Carlton Turner (Planning Commission).

Called to order at 7:30 P.M. [...]

Mr. Maurice Lichtenstein, 1614 E. Upsal St., Philadelphia discussed and presented preliminary plot plans for the development of 6.8 acres at the western end of the Borough into apartment units. Referred to Planning Commission for review and recommendation. [...]

Letter received from Fruit Growers of Chester County, Inc., requesting Council to study flooding conditions of Goose Creek. Referred to Street Committee. [...]

Letter received from Pa. Dept. of Health that Borough application for a permit to fluoridate the water supply of West Chester had been withdrawn. [...]

Mr. Cosgriff raised question of charge for permit for rooming houses. It was decided that fee of One Dollar ($1.00) is to be charged for each room or dwelling unit regardless of the number of persons occupying room or dwelling unit. [...]

Council members present: Mosteller, Spaziani, Conner, Cosgriff, Thomas and Underwood.

Also present: Kauffman, Hall, Slack and Melton, members of the Borough Planning Commission.

Called to order at 7:30 P.M. [...]

Mr. Lichtenstein presented and discussed in detail his proposed plans for development of area at Downingtown Pike and Marshall Street into apartment units. Dr. Coleman and Tate, Wells, Jerehian and Berardi, residents of the surrounding area, spoke against approval of the proposed plans. After considerable discussion, Mr. Lichtenstein and members of the Borough Planning Commission retired from the meeting for further review and discussion of the plans. [...]

Borough Council of West Chester, special meeting minutes (October 26, 1960).

Council members present: Mosteller, Spaziani, Conner, Cosgriff, Thomas, Baldwin and Underwood.

Also present: Burgess Lucas and Solicitor Marrone.

Called to order at 8 P.M. [...]

Report of Planning Commission meeting of October 25, 1960 included a recommendation " That the proposed Plan of Property, submitted by Maurice Lichtenstein, be approved providing that the necessary details for water, sewerage and services are worked out satisfactorily with Borough Council thru the Borough Engineer; and that the proposed driving surface of the extension of Marshall Street be increased from thirty feet (30 ft.) to a minimum of thirty-four feet (34 ft.).". [...]

1960/10/31
Borough Council of West Chester, special meeting minutes (October 31, 1960).

Council members present: Mosteller, Spaziani, Conner, Cosgriff, Thomas and Underwood.

Also present: Mr. Bayliss (Public Works), Mr. Kauffman (Planning Commission) and Mr. Maurice Lichtenstein.

Called to order at 8 P.M.

President Mosteller opened the meeting by stating that this part of the meeting was to review and discuss proposed plans of Mr. Lichtenstein and requested Secretary to read two letters received approving the plan. He then called on Mr. Lichtenstein to present his plans.

Mr. Lichtenstein presented and discussed his proposed plans and reported that he had submitted proposed utility plans to Mr. Bayliss for review and recommendation. Mr. Bayliss stated that the utility plans seemed satisfactory but that he wanted to check with the Pa. Dept. of Highways the proposed plans for storm drains and sewers. After considerable discussion the following conditions were stipulated:.

1. Developer will install entire water line loop.

2. Fire Hydrant to be moved temporarily from Cul-de-Sac by developer.

3. Developer to provide one year maintenance bond on all road and utility installations.

4. All drainage to be on property.

5. Borough to bring water line to edge of development.

President Mosteller, before requesting action by Council, asked if there were any persons present who wished to speak relative to the proposed subdivision plans.

Mr. E. Biehn, of 308 S. Church St. spoke in favor of the plans.

Berardi, Zaber, Landrum and Heald all spoke concerning problems that would be created by the approval of the sub-division plans and indicated that they were not in favor of the plans.

After a motion by Mr. Spaziani, seconded by Mr. Conner, the proposed plot plans were approved by a vote of 6 Yeas - subject to the stipulations previously noted and the execution of a satisfactory agreement relative to finances, etc. Referred to Solicitor. [...]

President Mosteller presented and discussed ordinances of other municipalities relative to activities of Peddlers and Close-Out Sales. He suggested that members of Council, the Solicitor and Secretary read the ordinances before the next regular meeting of Council. [...]
